1. Purpose and Scope

Hogahero is an international digital publishing and advertising platform dedicated to the hospitality industry.

This User Content & Marketplace Policy establishes the rules for submitting, publishing, managing, and promoting user-generated content on www.hogahero.com.

It applies to registered users, property and business owners, authorized representatives, professional brokers, agencies, advertisers, and other individuals or organizations submitting content to the platform.

This Policy supplements our Terms and Conditions, Listing Disclaimer, Privacy Policy, and other applicable platform policies.

2. User-Generated Content

Users may submit content including:
• Hospitality property and business listings
• Professional broker and agency profiles
• Business descriptions and commercial information
• Property descriptions and supporting documentation
• Photographs, images, and videos
• Contact information and website links
• Other hospitality-related promotional materials permitted by the platform

Users remain responsible for the content they submit and for ensuring that it complies with applicable laws and this Policy.

Hogahero reserves the right to determine which categories of content and advertisements are accepted for publication.

3. Ownership and Authorization

By submitting content to Hogahero, users confirm that they are legally entitled to publish the materials.

Private property and business owners may advertise their own hospitality properties or businesses without maintaining a professional website or operating as licensed brokers, provided they are legally entitled to offer the relevant property or business.

Where content concerns a property or business belonging to another party, the submitting user must have appropriate authorization from the owner or rights holder.

Users must not publish listings for properties or businesses they are not authorized to advertise.

Hogahero may request reasonable evidence of ownership, authorization, or the right to publish submitted materials where necessary to address suspected misuse, fraud, or legal violations.

Submitting a listing does not constitute verification or certification of ownership or authorization by Hogahero.

4. Professional Brokers and Agencies

Professional brokers, real estate agents, business brokers, and agencies wishing to publish professional profiles on Hogahero must provide accurate business information and sufficient details to establish their professional identity.

This may include an active business website, verifiable agency affiliation, official business registration, or other independently verifiable evidence of professional activity.

Hogahero reserves the right to request additional information before or after publication and to reject, suspend, or remove professional profiles where the information provided is insufficient, misleading, or cannot reasonably be substantiated.

Professional brokers and agencies are responsible for ensuring that they hold all licenses, registrations, qualifications, and authorizations required for their activities under the laws of the jurisdictions in which they operate.

Hogahero does not routinely verify professional credentials, licensing status, or regulatory compliance unless required by applicable law.

The publication of a professional profile does not constitute verification, accreditation, endorsement, or certification by Hogahero.

These professional profile requirements do not apply to private owners advertising their own properties or businesses, although all users remain subject to applicable legal requirements and the general rules of this Policy.

5. Accuracy and Transparency

Users must ensure that information submitted to the platform is accurate to the best of their knowledge, reasonably current, and not misleading.

This includes, where applicable:
• Asking prices and commercial terms
• Property and land measurements
• Business descriptions and operating details
• Photographs and visual representations
• Availability and listing status
• Financial information and performance claims
• Relevant licenses, permits, and authorizations
• Professional affiliations and business credentials

Users must not intentionally conceal material information in a manner that makes their listing or professional profile deceptive.

Where information changes materially, users are responsible for updating or removing the relevant content.

Hogahero does not independently verify every statement, document, or representation submitted by users.

6. Photographs, Videos, and Intellectual Property

Users must have the necessary rights, licenses, and permissions to upload or publish photographs, videos, graphics, logos, descriptions, and other protected materials.

Content must not infringe copyrights, trademarks, privacy rights, publicity rights, or other rights belonging to third parties.

Where identifiable individuals appear in submitted materials, users are responsible for ensuring that publication complies with applicable privacy and image rights requirements.

Users must not submit copyrighted materials without appropriate authorization.

Hogahero may remove content where there are reasonable grounds to believe that it infringes third-party rights.

7. Artificial Intelligence and Digitally Altered Content

Users must not use artificial intelligence, digital editing, or other image manipulation techniques to materially misrepresent an advertised property, business, or professional activity.

AI-generated or substantially altered images must not be presented as authentic photographs where doing so would mislead viewers.

Where required by applicable law, users must clearly disclose the use of artificial intelligence or synthetic media.

Hogahero may request clarification, additional disclosure, or removal of visual content that could materially mislead prospective buyers or other platform users.

8. Prohibited Content and Activities

The following content and activities are prohibited:
• Fraudulent, fictitious, or deliberately misleading listings
• Advertisements submitted without appropriate authorization
• False professional identities, qualifications, or agency affiliations
• Content promoting unlawful transactions or activities
• Infringement of intellectual property or privacy rights
• Impersonation of individuals, companies, or representatives
• Discriminatory, threatening, or defamatory content
• Malicious software, phishing links, or deceptive websites
• Spam, unauthorized mass advertising, or automated fraudulent submissions
• Unauthorized collection or misuse of personal information
• Attempts to manipulate or disrupt platform functionality

Hogahero may restrict, suspend, or remove content or accounts where reasonably necessary to enforce these rules or comply with applicable law.

9. Public Visibility and Confidential Listings

Standard listings and public professional profile information may be accessible to website visitors, registered users, search engines, and third-party indexing services.

Users should carefully consider which information they make publicly available.

For Confidential / Off-Market Listings, selected identifying information may be withheld from public presentation according to the applicable service arrangements.

Confidential publication does not guarantee complete anonymity, particularly where a property or business may be identifiable through photographs, descriptions, location details, or publicly available information.

Users remain responsible for deciding which information they are authorized and willing to disclose.

10. Communication Between Users

Hogahero provides technical features that may allow visitors to contact listing owners, brokers, agencies, or other authorized representatives.

Users must communicate lawfully, professionally, and in good faith.

Inquiry forms must not be used for harassment, fraud, spam, unauthorized marketing, or other improper purposes.

Listing owners and representatives are responsible for handling inquiries and any subsequent discussions, inspections, negotiations, or transactions.

Hogahero does not act as a real estate broker, business broker, transaction representative, or contracting party between users.

Personal information received through inquiries must be handled in accordance with applicable privacy and data protection laws.

11. License to Use Submitted Content

Users retain ownership of the content they submit to Hogahero.

By submitting content, users grant Hogahero a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, publish, and distribute the submitted materials as reasonably necessary to operate and promote the platform.

This license includes the right to use submitted listing and professional profile content in connection with:
• Publication on the Hogahero website
• Social media promotion
• Newsletters and platform communications
• Marketing materials promoting Hogahero or the relevant listing or professional profile

Users confirm that they have the necessary rights to grant this license.

Hogahero does not acquire ownership of user-submitted content.

The license generally ends when the relevant content is removed from the platform, subject to lawful recordkeeping, technical backups, and promotional materials already distributed or published.

Hogahero will not represent itself as the owner of a listed property or business merely because it publishes or promotes the listing.

12. Content Review and Moderation

Hogahero does not undertake to independently verify every listing or professional profile or continuously monitor all user-submitted content.

However, Hogahero may review submitted content and take appropriate action where necessary to enforce platform rules, respond to complaints, protect users, or comply with legal obligations.

Such measures may include:
• Requesting corrections or additional information
• Requesting evidence of professional identity or authorization
• Restricting public visibility
• Rejecting or suspending publication
• Removing prohibited content
• Restricting or terminating accounts
• Reporting suspected unlawful activity where legally justified

Moderation decisions will be made in accordance with applicable law.

Where required, affected users will be informed of the reasons for restrictions and available complaint or review procedures.

13. Reporting Content and Rights Violations

Users, rights holders, and other affected parties may report content believed to be unlawful, fraudulent, misleading, or in violation of this Policy.

Reports should identify the relevant listing, professional profile, or other content and explain the concern, including supporting information where available.

Submitting a report does not guarantee that content will be removed.

14. Removal and Account Termination

Hogahero may retain certain information where required for legal compliance, accounting, security, dispute resolution, or other lawful purposes.

The handling and retention of personal information are described in our Privacy Policy.

Removal of content does not guarantee immediate removal from search engine indexes, third-party websites, caches, or previously distributed promotional materials.

15. Responsibility and Liability

Users remain responsible for their submitted content, including the accuracy of information, authorization to publish, professional representations, and compliance with applicable laws.

Hogahero provides the technical infrastructure for publication and communication but does not guarantee the authenticity, accuracy, legality, or commercial performance of user-submitted listings or professional profiles.

To the maximum extent permitted by applicable law, Hogahero shall not be responsible for losses or disputes arising from inaccurate user-submitted content or transactions independently conducted between users.

Nothing in this Policy excludes or limits liability that cannot lawfully be excluded or limited.

16. Changes to This Policy

Hogahero may update this Policy to reflect changes in platform services, applicable laws, technical functionality, or content moderation practices.

The revised version will be published with an updated revision date.

Where required by applicable law, users will receive additional notice of material changes.
